Abstract | Jeremy Bentham, in his writings about free press and free speech at the turn of the 19th century, advocated a very radical position regarding free expression. This is somewhat lost in the history of the topic because, unlike most other advocates of free speech and free, his ideas come from the utilitarian, not libertarian, tradition. He advocated for no pre-publicisation censorship, no prior restraint and punishment only due to “willful mendacity” (i.e. actual malice) of defamatory statements. Only by doing so could happiness be maximised as the cost of such a free speech standard was far less than the cost of censorship and suppression of the press and free assembly. At the time his approach was roundly rejected by liberal movements, yet on further reflection we can see how his argument is largely congruent with the modern conceptions of free expression as a check on “misrule”. |
